Supreme Court of Judicature. Two Appeals Heard. One Succeeds but the other fails Gleaner 10/11/1920

Appeal against previous conviction where Gayle was sentenced to 30 days imprisonment. Gayle had gone into a shop at Frankfield and told a woman that her life was in danger, and offered to help her. Defence lawyer JAG Smith argued that there was no evidence to support a charge of practicing obeah and that the evidence for the conviction had been wholly unsatisfactory. The Attorney General pointed out that the conviction was well founded and that the appellant did profess to have supernatural powers. After the case had been fully argued His Honour decided that the evidence was not of such a nature that a conviction could be sustained. Upheld appeal and quashed the conviction.
